the qualification, documents, extension and targets for the F1 visa

Target

- Overseas adoptees who held South Korean nationality at birth

- Domestic helpers of foreign diplomatic missions in South Korea

- Co-residents who do not belong to the household of a person who qualifies for a diplomatic (A-1) or treaty (A-3) visa

- Accompanying children or other family members of SOFA (Status of Forces Agreement) personnel who are over 21 years old

- Spouses or minor children of individuals who hold a residence (F-2) visa

- Minors who need to be supported by a parent who is a South Korean citizen and has an address in South Korea

- Those who are deemed to need to stay in South Korea for a long period of time for unavoidable reasons without engaging in professional activities

The maximum period of stay that can be granted at one time is 2 years.

Permission for activities outside of visa status

1. The scope of exemption for permission for activities outside of visa status has been expanded

If you want to receive education from a regular educational institution (elementary, middle, high school, and university) without infringing on the original purpose of stay, you can get separated permission

2. Permit for activities outside the scope of qualifications for Chinese compatriots holding a F-1 (Visiting and Joining Family) visa who meet certain employment qualifications for Professor (E-1) to Specific Activities (E-7)

※ This refers to cases from E-1 to E-7 (excluding hotel/entertainment workers (F-6-2) and skilled workers (E-7-4))

Granting of stay qualification

Immigration Control Act Article 23

- Foreigners who were born in the Republic of Korea and have to stay without a stay qualification must obtain a stay qualification within 90 days from the day of their birth,

- Foreigners who have to stay without a stay qualification due to loss or departure of Korean nationality or other reasons while staying in the Republic of Korea must obtain a stay qualification within 30 days from the day the reason occurred according to the Presidential Decree.

In other words, foreign nationals born in Korea must obtain a qualification within 90 days of birth

1. For those who have been discharged locally from the US military in Korea, stay qualifications are granted within the range of Agreement (A-3), Short-term Visit (C-3), Visiting and Joining Family (F-1), Residence (F-2), and Other (G-11) qualifications according to the purpose of stay

2. Grantingof F-1 (Visiting and Joining Family) stay qualification for children born in Korea of F-2 (Residence) visa holders

5. Granting of stay qualification for minor children born in Korea of excellent talents under the point system (F-2-7)

a. Target for stay permit

Children born in Korea of excellent talents under the point system (F-2-7) whose annual income is less than the recent per capita national income

b. Review requirements

1) Applicant (minor child) requirements

- Must be born in Korea

- Must not fall under the disqualification reasons (reasons for change of stay qualification)

2) Requirements of Mother of the applicant

- Must be legally staying as an excellent talent under the point system (F-2-7 or F-1-12)

- However, if the mother of the applicant meets the requirements for changing the stay qualification in Korea to the stay qualification as the spouse of an excellent talent under the point system (F-1-12), the mother's requirements are considered to be met

* If the mother of the applicant is staying with a short-term stay qualification or a long-term stay qualification that cannot be changed to another qualification in Korea according to various guidelines (Other (G-1), Tourist Employment (H-1), etc.), it is considered not met

- Children born in Korea to mothers who entered Korea with a short-term stay qualification (B-1, B-2, C-3) are not allowed to be granted a long-term stay qualification and must leave the country, obtain a relevant visa, and enter the country

3) Requirements of excellent talents under the point system (F-2-7)

- In the case where the mother of the child is the 'spouse of an excellent talent under the point system (F-1-12)', the father must meet the review standards for changing the stay qualification of excellent talents under the point system and have an annual income less than the recent per capital national income

Permit of change stay qualification

​1. Change of stay qualification to F-1 (Visiting and Joining Family) for non-family members and housekeepers working at foreign consulates worker, etc., in Korea

a. Target

- Non-family members living with those with diplomatic (A-1), official (A-2), or agreement (A-3) qualifications

- Housekeepers of foreign consulate staff in Korea

※ Housekeepers of foreign investors and professionals cannot change their stay qualification in Korea. In this case, they must enter the country with a consulate visa or a visa issuance certificate

*The range of accompanying family members of those working at foreign consulates, etc., in Korea (A-1, A-2) includes

1. Legally married spouse. However, the status of the spouse may not be recognized if it violates Korean law or is against good morals or other social order.

2. Parents over the age of 61 of the person or their spouse

3. Parents under the age of 60 who do not engage in income-generating activities during their stay

4. Unmarried minor children according to the Civil Law

5. Unmarried children under the age of 26 who are full-time students at regular educational institutions in Korea.

6. Unmarried adult children according to the Civil Law who are disabled and unable to maintain their own livelihood.

2. Permit of change of stay qualification for parents of foreign spouses married to Korean

a. Parents of marriage immigrants (up to 2 people allowed)

1. (Initial settlement support stage)

- Parents who entered the country within 1 year from the first entry date of the marriage immigrant, allowed to stay within the range of 1 year of stay

2. (Childbirth and childcare support stage)

- In case of pregnancy and childbirth of a marriage immigrant, it is allowed within the range of up to 4 years and 10 months for the purpose of childbirth and childcare support, limited to the end of March of the year when the child reaches the age of 7.

b. Family of marriage immigrants (up to 1 person)

- Limited to 1 female blood relative within 4 generations of 18 years or older among the families of marriage immigrants (married naturalized citizens)

- If the marriage immigrant is pregnant and the parents are deceased or elderly over 65 years old, etc., and it is difficult to support childbirth and childcare, it is allowed within the range of up to 4 years and 10 months for the purpose of childbirth and childcare support, limited to the end of March of the year when the child reaches the age of 7.

c. Additional humanitarian stay requirements

Regardless of the presence or age of children, stay is allowed for parents or other family members within the range of up to 4 years and 10 months until the humanitarian reason disappears if they meet each of the following requirements

- If the marriage immigrant or their spouse needs a family member to take care of due to a severe illness that makes it difficult to live a normal life due to long-term hospitalization or treatment, etc.

- If the child of a marriage immigrant has a disability and is needed for their upbringing

- If the marriage immigrant is raising a child alone due to the death of a spouse, divorce, etc.

- Marriage immigrant families raising three or more children

- If there are other humanitarian reasons similar to the above

Stay qualification: Visiting cohabitation (F-1-5)

Permit period

- Grant a stay period of 1 year

(Subsequent extension of stay is allowed within the range of 2 years from the expiration date if the need for stay is recognized)

- However, stay is allowed up to 4 years and 10 months from the date of entry

⑨ Death diagnosis certificate of the parent (married naturalized citizen) of the marriage immigrant, disease diagnosis certificate, etc. that can prove that the parent's support cannot be received (for applicable persons)

3. Change of stay qualification permit for visiting and living together for organizing housekeeping of marriage immigrants whose marriage has been severed

a. Stay permit target

- Those who have severed marriage with a national but are not eligible for marriage severance (F-6-3) and need to stay in Korea for reasons such as property division and organizing housework

b. Review criteria and points to note

- The inevitability of staying in Korea

c. Stay permit period: within the range of 6 months each time

- The stay permit period of F-16 qualification is up to 1 year from the date of qualification change

- However, if a lawsuit (including small claims adjudication request) continues due to reasons such as debt, debt, return of security deposit due to real estate lease, stay permit until the end of the lawsuit even if 1 year has passed from the date of qualification change

5. Change of stay qualification permit for visiting and living together (F-1-11, F-1-9) for spouses and minor children of visiting workers (H-2), overseas Koreans (F-4)

Spouses and minor children of visiting workers (H-2) who are legally staying in Korea are allowed to stay as visiting cohabitants (F-1) until the stay period of visiting workers (H-2), and minor children of overseas Koreans (F-4) are allowed to stay until the age of 25 (excluding married children).

7. Change of stay qualification permit to visiting cohabitation (F-1-13) for parents accompanying foreign students in high school or lower

a. Applicable person

- One person per foreign studentwho has received admission from the educational institution and is planning to enter or is currently enrolled, and is a relative within the second degree of the foreign student who meets certain requirements such as financial requirements.

- Living expenses (1 year's living expenses)

· 1 year's living expenses: 19 million won in Korean currency per person

- Financial requirements (citizens of countries with a high incidence of illegal stay)

· Citizens of countries with a high incidence of illegal stay are limited to those who meet financial requirements such as an annual income of 37.4 million won or more or assets equivalent to 199 million won or more.

* Financial requirements can be chosen from either annual income or asset ownership requirements, and the income or assets of a couple can be combined.

- Other requirements

If you have been fined 2 million won or more for violating the Immigration Control Act, etc. within the past 5 years, or if you have been subject to forced deportation or departure order, visa (recognition) issuance is restricted.

b. Delegation of authority (office, branch office)

Grant a stay period of up to 2 years from the date of permit within the stay period of the recognized refugee

10. Change of stay qualification permit to visiting cohabitation (F-1-28) for foreign nationality parents of naturalized citizens

a. Change of stay qualification target and allowed number of people

Parents (including stepfather and stepmother) of naturalized citizens: Up to 2 people per naturalized citizen's household

* Excludes cases where the marriage immigrant is subject to F-1-5 guidelines

* Even if both spouses are naturalized citizens, the maximum is 2 people

Female blood relatives within the fourth degree of kinship of the naturalized citizen: 1 person per naturalized citizen's household

- However, it is limited to cases where the naturalized citizen's parents have died or are unable to provide humanitarian support for childbirth and child rearing due to reasons such as being over 65 years old. Cases where a kinship relationship is formed due to adoption are excluded from the target.

b. Change requirements

1) Age

- Must be an adult under civil law at the time of application

2) Applicant's stay qualification

- Only the stay qualification received by proving the kinship with the naturalized citizen at the overseas consulate is possible

*Visa exemption (B-1), tourist pass (B-2) are not stay qualifications that have proven kinship, so they are not eligible for qualification change

3) Compliance with laws and regulations and character requirements *Requirements for each applicant and inviter (spouse) must be met

- Violated the Immigration Control Act 3 times or more within 3 years before the application date

- Received a sentence or final decision for a serious crime within 10 years before the application date

- However, even if 10 years have passed since the application date, if it is judged to be unsuitable for long-term stay in Korea when considering the motive, means, method, and content of the crime, it can be reviewed as not meeting the character requirements

* Probation, suspended sentence fines (regardless of amount) are also included in the violation

- If there is a reason for entry ban as of the qualification change review date

- If taxes, etc. are in arrears as of the application date

② Soundness of the past invitation career of the inviter or the inviter's spouse

There should be no fact that a foreigner invited by the inviter (naturalized citizen) or the inviter's spouse applied for refugee status or stayed illegally within 3 years before the application date

There should be no case where a foreigner invited by the naturalized couple violated the actual law, etc. and had a poor stay status, or stayed for a long time without the ability to lead a healthy domestic life within 3 years before the application date

* If the invitee has received a stay of departure or is staying with other (G-1) stay qualifications other than normal stay qualifications, it will be decidedafter a detailed investigation

4) Reason for visiting cohabitation (need for domestic stay): Must meet one or more of the following reasons

Support for childbirth and child rearing of naturalized citizens

If the naturalized citizen is pregnant

If the naturalized citizen's child is under 7 years old as of the end of March of the year

If the naturalized citizen is raising three or more minor children (under civil law)

If the naturalized citizen's spouse has died or divorced, etc., and the naturalized citizen is raising a minor child (under civil law) alone

If the naturalized citizen's child has a disability and needs to be raised

Humanitarian support for naturalized citizens

If the naturalized citizen or his/her spouse needs a family member to take care of due to a serious illness that requires long-term hospitalization or treatment, making normal life difficult

* If the spouse is a foreign national, it is subject to F-1-5

Permit of Stay extension

1. Extension of stay for those who entered the country for the purpose of visiting domestic relatives.

Required documents

③ Identity guarantee (for those over 20 years old)

④ Proof of residence (lease agreement, confirmation of accommodation provision, notice of expiration of stay period, receipt of public fee payment, receipt of dormitory fee, etc.)

2. Extension of stay for those who entered the country with a visiting cohabitation (F-1) visa as a first-generation Chinese compatriot and those who entered the country for a visit to relatives.

a. Permit criteria: There must be an identity guarantee from domestic relatives, etc.

b. Stay permit period: Up to 1 year from the date of permit

- Continuation of stay is allowed, but permit for extension of stay for 1 year

c. Required documents

① Application form (Form 34), passport and alien registration card, fee

② Certificate of family relationship that can prove that you are a first-generation Chinese compatriot or a family member or relative, and other identity relationship materials

3. Non-family cohabitants or domestic helpers of foreign consular officials in Korea

4. Unmarried and are adults under civil law children of spouses who are married to nationals

a. Extension of stay is allowed for up to 6 months each time if the necessity of domestic stay continues.

b. Status investigation: Conduct a status investigation every 1 year

If a person with multiple nationalities who entered Korea with a foreign passport intends to continue residing in Korea with a registered address, they must register as a resident.

5. Extension of stay permit for visiting cohabitants for property division of marriage immigrants whose marriage has been severed

a. Permit target

Extension of stay for individuals who have ended their marriage with a Korean citizen but are not classified as divorced (F-6-3), and need to stay in Korea for reasons such as property division, household affairs, etc.

b. Review standards and points to note

Necessity of staying in Korea

c. Period of stay: Up to 6 months each time

- The period of stay for F-1-6 is up to 1 year from the date of change of status

- However, if a lawsuit (including small claims) continues due to reasons such as claims, debts, return of security deposit due to real estate lease, etc., stay is permitted until the end of the lawsuit even if 1 year has passed since the date of change of status

6. Domestic helper of foreign investors and excellent professionals

a. Approval standards

- Maximum 1 year within the employer's stay period

- Must live at the same address as the employer during the stay period, and activities other than domestic help such as employment are prohibited

- Principle of departure when the qualification of domestic helper is lost due to termination of employment contract, non-compliance with employer requirements, etc.

- Limit of 1 foreign domestic helper per inviter
